Reforming the Criminal Law in Zimbabwe: A Case Study

Case Study, March 2025

In 2022, Zimbabwe repealed its overly broad and vague HIV-specific criminal law, becoming only the second country in Africa to do so.

  • What made this repeal effort successful?
  • What strategies did advocates and policymakers employ?
  • And what lessons can communities worldwide take from Zimbabwe’s experience?

This case study explores the key factors behind Zimbabwe’s successful law reform, offering insights for advocates, policymakers, and community members in countries where laws criminalising HIV non-disclosure, exposure, or transmission remain in place. It draws on perspectives from those directly involved in the process.

This case study complements the 24-minute documentary “It is Time!” – How Zimbabwe Decriminalised HIV, providing a framework for deeper conversations following a viewing or screening.

The case study was written by Alison Symington and edited by Edwin J Bernard, with additional research by Elliot Hatt, and informed by the insights and expertise of:

  • Immaculate Owomugisha Bazare, Center for Women Justice Uganda / ICW
  • Dorcas Tatenda Chitiyo, Health Law and Policy Consortium;
  • Tambudzai Gonese-Manjonjo, Southern Africa Litigation Centre
  • Tinashe Mundawarara, formerly Zimbabwe Lawyers for Human Rights
  • Tonderai Mwareka, Zimbabwe National Network of People Living with HIV/AIDS.
