Overview

Kiribati does not have an HIV-specific criminal law and, although there is a general disease provision in the Penal Code criminalising negligent acts ‘likely to spread the infection of any disease dangerous to life’, there have been no known HIV criminalisation cases in Kiribati which, at the end of 2016, had an estimated 23 people known to be living with HIV.

Section 176. Negligent act likely to spread infection of disease dangerous to life

Any person who unlawfully or negligently does any act which is, and which he knows or has reason to believe to be, likely to spread the infection of any disease dangerous to life, is guilty of a misdemeanour.
