Overview

The legislature and judiciary in Prince Edward Island have not developed the legal position on HIV criminalisation beyond the federal standard. As such, the law reflects the position outlined in R. v Mabior.

Research by the HIV Legal Network did not identify any cases of HIV non-disclosure in Prince Edward Island. Similarly, we are not aware of any reports of HIV criminalisation in the province.
