Overview
The legislature and judiciary in Newfoundland and Labrador have not developed the legal position on HIV criminalisation beyond the federal standard. As such, the law reflects the position outlined in R. v Mabior.
Research by the HIV Legal Network identified six cases of HIV non-disclosure in Newfoundland and Labrador up to 2020. The circumstances of these cases are not clear as we do not have access to any case reports in the province.
