Overview

There does not appear to be any HIV criminalisation in Afghanistan.

The 2017 Penal Code replaced the 1976 Penal Code. It was adopted on 15 May 2017 and entered into force on 14 February 2018. HJN is not aware of any relevant provisions under this law, however, we were unable to translate the Penal Code to confirm.

We are not aware of any cases of HIV criminalisation.

UNAIDS reported in its Data 2024 report that there is no HIV criminalisation in Afghanistan.
