In a recent appeal hearing, a three-year imprisonment sentence for an individual convicted of risking HIV transmission was upheld by the court. The case centered on repeated incidents where the convicted person, who was aware of their HIV-positive status and had been registered at a regional AIDS center, engaged in unprotected sexual activities without disclosing their condition. These incidents occurred between 2023 and 2024 and involved multiple partners in various locations, including a dormitory, private residences, and an open field.
Despite warnings from the AIDS center staff about the legal and ethical obligations to prevent transmission, the individual continued this behavior. The evidence included confessions, epidemiological investigation reports, witness testimonies, and supporting photographs. The appeal for a lighter sentence, which cited the convicted person’s confession, remorse, and personal circumstances, was rejected. The court found the original ruling consistent with Uzbekistan’s Criminal Code, emphasizing the severity of the offense and the need for deterrence and correction.
