Uzbekistan: Fergana Appeal Court dismisses appeal of man sentenced for alleged HIV exposure

An appellate court in the Fergana region reviewed the case of a defendant convicted of exposing another individual to the risk of HIV transmission. The original court found that the defendant, previously diagnosed with HIV and warned of the legal consequences of exposing others, attempted to engage in sexual activity for money without disclosing his status.

He was sentenced to three years’ imprisonment in a general regime colony under Part 4 of Article 113 and Article 57of the Uzbek Criminal Code. During the appeal, the defendant admitted guilt, expressed remorse, and requested a more lenient, non-custodial sentence due to difficult family circumstances and health concerns of close relatives.

The appellate court determined that the original trial had thoroughly considered all evidence, including testimonies, medical records, and procedural fairness. It concluded that the lower court’s decision was legally sound and justified, and found no basis to alter or reduce the sentence. The appeal was therefore dismissed, and the original verdict was upheld.
