Uzbekistan: Appeal dismissed in case of HIV exposure, despite request for leniency from his wife

An individual was convicted for “knowingly” putting his spouse at risk of HIV infection. Despite being diagnosed as HIV-positive in 2021, he entered into a legal marriage in November 2024 without disclosing his status. They engaged in unprotected sexual intercourse, endangering his spouse.

The district court originally found the defendant guilty under Article 113, Part 4 of the Criminal Code and sentenced them to 3 years of imprisonment. The victim appealed, requesting leniency, arguing that the convicted person was the sole financial provider for the family.

The regional court reviewed the case on March 13, 2025, and upheld the initial verdict, ruling that the punishment was fair and proportionate to the offense, as the actions posed a serious public health risk. While the defendant’s remorse and confession were considered as mitigating factors, imprisonment was deemed necessary.
