Sentence of the Ternivsky City Court of Dnipropetrovsk Region
The verdict of the Ternivka Town Court of the Dnipropetrovsk region sentenced an HIV-positive woman under Part. 1, Art. 130 to two years of limitation of her liberty with exemption from punishment and establishment of a probation sentence for 2 years.
In the period 2010-2011 the defendant knew of their HIV-positive status and without disclosing about her disease to her sexual partner, regularly entered in unprotected sexual relationship with him. Once the partner learned of the presence of HIV, he did not believe in it and insisted on continuing their relationship. However, the woman initiated the broke up in their relationship, then at the request of the partner against her a criminal proceedings were started for putting him in danger of HIV. The partner’s test was HIV-negative.
Вирок Тернівського міського суду Дніпропетровської області, яким ВІЛ-позитивну жінку було засуджено за ч. 1 ст. 130 до двох років обмеження волі зі звільненням від відбування покарання та встановленням іспитового строку 2 роки.
У період 2010-2011 років підсудна, знаючи про свій ВІЛ-позитивний статус та не повідомляючи про нього свого статевого партнера, регулярно вступала з ним у незахищені статеві стосунки. Після того, як партнер дізнався про наявність у підсудної ВІЛ-інфекції, він не повірив у це і наполягав на продовженні їх стосунків. Втім, з ініціативи жінки стосунки припинилися, після чого за заявою партнера проти неї було порушено кримінальне провадження за поставлення його у небезпеку інфікування ВІЛ. Тест на ВІЛ партнера виявився негативним.
