The verdict of the Shevchenkivsky district court of the city of Chernivtsi
The sentence the Shevchenko District Court of Chernivtsi sentenced HIV-positive man to 4 years in prison for criminal offenses under Part 1 Art.125 (intentional bodily harm), Part Art.130 (HIV exposure), Part 2 Art.186 (robbery with violence not dangerous to life or health of the victim) and Part 2 Art. 15 (attempted crime) of the Criminal Code of Ukraine.
After committing the abduction of a property the convicted man was seen by the victim who tried to keep the thief till the arrival of the police. In order to escape from the scene, the condemned man knowing that he was HIV-positive bit the victim on the hand. The court sentenced the man for robbery blog with Part 1 of Art. 130 of the Criminal Code of Ukraine for the fact that he deliberately put another person at risk of HIV transmission. At the court the man acknowledged his guilt in full.
Вирок Шевченківського районного суду міста Чернівці, яким засуджено ВІЛ-позитивного чоловіка до 4-х років позбавлення волі за вчинення кримінальних правопорушень, передбачених ст.125 ч.1, ст.130 ч.1, ч.2 ст.186, ч.2 ст.15 ч.2 ст.186 КК України.
Після вчинення відкритого викрадення чужого майна чоловік (засуджений) був помічений потерпілим, який намагався утримати крадія до приїзду працівників міліції. З метою втечі з місця події засуджений вкусив чоловіка за руку, знаючи, що він є ВІЛ-позитивним. Суд засудив чоловіка (окрім як за грабіж) також за ч. 1 ст. 130 КК України за те, що він свідомо поставив іншу людину у небезпеку зараження ВІЛ. У суді засуджений свою вину визнав повністю.
