Sick, he infected his ex and lied to his new girlfriend
By Frédéric Nejad Toulami – A man is being tried for hiding from his ex-wife that he was infected with HIV and hepatitis C. He did not say anything either to his new partner.
The attitude of this Mauritian in an illegal situation has not generated sympathy from either the President of the Court or the public prosecutor. Judged on Tuesday in Lausanne, the 39-year-old man arrived in Switzerland in 2013. He was then probably already infected with HIV, after having unprotected homosexual relations in his country of origin.
After meeting a woman on the internet, they slept together, then they got married. But he never warned her or offered to wear a condom. However, in the summer of 2013, the Mauritian medical authorities had warned him that there was “a problem with his blood”. He did not worry and told the Court that he did not know what AIDS was. Yet he infected the woman who is now his ex-wife. He was prosecuted in 2014, after having tests that confirmed that the man was infected with hepatitis C and HIV.
“Why did not you tell your new girlfriend in April 2014?” And why did you not ever wear a condom? “asked the president. “I did not want to frighten her and attract his suspicions,” he replied.
The triple therapy he takes has fortunately made it possible for his HIV to be neutralised. Pleadings and indictment will take place after the Court has obtained additional information from doctors.

L’attitude de ce Mauricien en situation illégale n’a suscité l’empathie ni de la présidente de la Cour ni du procureur. Jugé mardi à Lausanne, cet homme de 39 ans est arrivé en Suisse en 2013. Il était alors déjà probablement atteint du VIH, à la suite de relations homosexuelles non protégées dans son pays d’origine.
Après avoir rencontré une femme sur internet, ils ont couché ensemble, puis ils se sont mariés. Mais il ne l’a jamais mise en garde ni n’a proposé de mettre une capote. Pourtant, en été 2013, les autorités médicales mauriciennes l’avaient averti qu’il y avait «un problème avec son sang». Il ne s’était alors pas inquiété et a déclaré à la Cour qu’il ne savait pas ce que c’était que le sida. Il a pourtant contaminé celle qui est désormais son ex-épouse. Celle-ci l’a attaqué en justice en 2014 (lire encadré), après avoir effectué des tests qui ont confirmé que l’homme était atteint des virus de l’hépatite C et du VIH.
«Pourquoi n’avez-vous rien dit à votre nouvelle copine, dès avril 2014? Et pourquoi n’avoir jamais mis de préservatif?» demande la présidente. «Je ne voulais pas lui faire peur et attirer ses soupçons», répond-il.
La trithérapie qu’il suit a heureusement permis de neutraliser le VIH. Plaidoiries et réquisitoire interviendront après que la Cour aura obtenu un complément d’information auprès de médecins.
