Convicted of having infected her husband with HIV
A woman in the Stockholm area will pay 600,000 kronor in damages for having infected her former husband with HIV.
The woman has previously been released in the district court but has now been convicted in Svea Court of Appeal now for her illness, since she must have infected her former husband with HIV.
The District Court considered that the husband had given his consent. The Court of Appeal, on the other hand, disagreed with the woman after referring to a statement by the Supreme Court, which stated that consent to the transmission of HIV does not have a liability-free effect.
The woman receives a conditional sentence and will pay close to 600,000 kronor plus interest to the plaintiff.

En kvinna i Stockholmsområdet ska betala 600.000 kronor i skadestånd för att ha smittat sin dåvarande make med hiv.
Kvinnan har tidigare friats i tingsrätten men döms nu i Svea hovrätt nu för vållande till sjukdom, då hon ska ha smittat sin dåvarande make med hiv.
Tingsrätten ansåg att maken hade givit sitt samtycke. Hovrätten däremot fäller kvinnan efter att ha hänvisat till ett uttalande av Högsta domstolen, vilket säger att samtycke till överförande av hiv inte har ansvarsbefriande verkan.
Kvinnan får villkorlig dom och ska betala närmare 600.000 kronor plus ränta till den målsägande.
