Man living with HIV convicted of careless sex
GOTHENBURG A 43-year-old man from Gamlestaden was sentenced to community service, for having sex with three people without informing them of his HIV.
The man was prosecuted just before Christmas 2012. After that, the court hearing was held no less than four times before the parties could finally meet – a fifth time – for a decision.
The delays are partly due to the fact that the accused himself did not hear the call and did not feel good, partly because the witnesses had prevented.
According to one of the plaintiffs who want to have the process overtaken, the delay has meant an enormous mental strain.
She and another woman have now been awarded SEK 20,000 in damages.
At the trial on June 19, the man admitted much of what he was accused of, except for one offense. However, he did not feel guilty of any crime.
According to the judgment, the 43-year-old, who has previously been unpunished, had unprotected intercourse with two women for a total of one hundred occasions in 2011.
In addition, during the same period of time, but only once, he had sexually intercourse with another woman.
The prosecutors have argued that the man had a duty to inform his partners that he tested HIV-positive. This perception is shared by the court, which sentenced the 43-year-olds for endangering others.
The sentence is set to be a conditional sentence with community service for 220 hours. If a detention had been chosen instead, nine months’ imprisonment would have been sentenced.
“However, there is no particular reason to fear that the suspect will commit further crime,” the District Court writes.

Mannen åtalades strax före jul 2012. Efter det sköts domstolsförhandlingen upp inte mindre än fyra gånger, innan parterna slutligen kunde samlas – vid ett femte tillfälle – för ett avgörande.
Dröjsmålen har dels berott på att den tilltalade själv inte hörsammat kallelsen och inte mått bra, dels på att vittnen haft förhinder.
Enligt en av de målsägande, som vill ha processen överstökad, ska förhalandet ha inneburit en enorm psykiskt påfrestning.
Hon och en annan kvinna tilldelas nu vardera 20 000 kronor i skadestånd.
Vid rättegången den 19 juni medgav mannen mycket av det som han anklagats för, utom en misshandel. Han ansåg sig dock inte skyldig till något brott.
43-åringen, som är tidigare ostraffad, har enligt domen haft oskyddade samlag med två kvinnor vid sammanlagt ett hundratal tillfällen under 2011.
Dessutom hade han, under samma tidsperiod men bara någon enstaka gång, sexuellt umgänge med ytterligare en kvinna.
Åklagarna har hävdat att mannen haft en skyldighet att informera sina partners om att han testat hiv-positivt. Den uppfattningen delas av domstolen, som fäller 43-åringen för framkallande av fara för annan.
Påföljden fastställs till villkorlig dom med samhällstjänst i 220 timmar. Om ett frihetsberövande i stället hade valts, skulle nio månaders fängelse ha dömts ut.
“Det saknas emellertid särskild anledning att befara att den misstänkte kommer att göra sig skyldig till fortsatt brottslighet”, skriver tingsrätten.
