Judgment for sexual exploitation of children
ÖSTERGÖTLAND An HIV-infected 16-year-old had unprotected intercourse with a minor girl. Now the court has changed his judgment.
In the spring of 2016, the boy living in the western part of the county had unprotected oral sex with her girlfriend. She was then under 15 years. The boy was aware that he was HIV positive, but misunderstood the medication and concealed the information from his girlfriend.
In the district court, the 16-year-old was sentenced for sexual exploitation of children and attempted gross maltreatment. The sentence was youth care and 100 hours of youth service. The girl would receive damages of SEK 15,000.
However, the judgment was appealed to the Court of Appeal, which made a somewhat different assessment than Linköping District Court. The point of sexual exploitation of children is fixed, but the court of appeal made a different assessment of the attempted drug abuse in terms of the risk of infecting the girl with HIV. The Court of First Instance referred to preliminary rulings that the risk of transmission of infection was low. Reference is also made to the boy’s low age because at the time he was only 15 years old. At this point he is has been freed.
The court of appeal also changes the sentence to 50 hours of youth service, but raises the damage to SEK 30,000.

ÖSTERGÖTLAND Den hiv-smittade 16-åringen hade oskyddat samlag med en minderårig flicka. Nu har hovrätten ändrat hans dom.
Våren 2016 hade pojken som är hemmahörande i västra länsdelen oskyddat oralsex med sin flickvän. Hon var då under 15 år. Pojken hade vetskap om att han var hiv-positiv, men misskötte medicineringen och undanhöll informationen från sin flickvän.
I tingsrätten dömdes 16-åringen för sexuellt utnyttjande av barn och försök till grov misshandel. Straffet blev ungdomsvård och 100 timmars ungdomstjänst. Flickan skulle få ett skadestånd 15 000 kronor.
Domen överklagades dock till hovrätten som gör en delvis annorlunda bedömning än Linköpings tingsrätt. Punkten om sexuellt utnyttjande av barn står fast, men hovrätten gör en annan bedömning vad gäller misshandelsförsöket i form av risken att smitta flickan med hiv. Hovrätten hänvisat till prejudicerande domar om att risken för smittoöverföring varit låg. Man hänvisar också till pojkens låga ålder eftersom han vid tillfället bara var 15 år. På den punkten frias han därför.
Hovrätten ändrar också domen till 50 timmars ungdomstjänst, men höjer skadeståndet till 30 000 kronor.
