The court of appeal released the HIV-infected man who had unprotected sex with several women in Skåne.
The district tribunal sentenced the man to one year in prison earlier this year and 190,000 SEK in damages, but since then, the Swedish Institute for Infectious Disease Prevention has provided a new report investigating HIV infection risks. The report states that the risk for an HIV positive who takes their medications to infect someone through vaginal intercourse is almost non-existent.
Important step for HIV infected patients
The court of appeal chose to await the report before making a decision, and today the prosecution was dismissed. And that means a lot for those living with HIV today, according to Marielle Nakunzi, Jurist at RFSU.
“This means we can reduce stigma against people living with HIV. I hope that this knowledge now spreads in the judiciary.
What is the next step?
– I hope that new guidelines will now be issued to prosecutors for dealing with such cases. It’s revolutionary and very, very pleasing, she says.
Jenny Fugleberg, who is the women’s representative stated that the court of law has done wrong.
“I was very surprised. My clients say they have lost confidence in the judiciary, she says.
She had warned her clients that there was an opportunity for the prosecution to be dismissed, but she thought it would end the prison sentence being halved. She can not currently comment on whether they will appeal or not.

Hovrätten friade den HIV-smittade man som haft oskyddat sex med flera kvinnor i Skåne.
Tingsrätten dömde tidigare i år mannen till ett års fängelse och 190 000 kronor i skadestånd, men sedan dess har Smittskyddsinstitutet kommit med en ny rapport som utredde hur stor smittorisken för HIV faktiskt är. I rapporten skriver man att risken att en HIV-positiv som tar sina bromsmediciner smittar någon via vaginalt samlag är näst intill obefintlig.
Viktigt steg för HIV-smittade
Hovrätten valde att invänta rapporten innan man fattade ett beslut, och idag ogillades åtalet. Och det betyder mycket för de som lever med HIV idag, enligt Marielle Nakunzi, Jurist vid RFSU.
– Det betyder att vi kan minska stigmat mot folk som lever med HIV. Jag hoppas att den här kunskapen nu sprider sig inom rättsväsendet.
Vad är nästa steg?
– Jag hoppas att man nu tar fram nya riktlinjer till åklagarna för hur man ska hantera sådana här fall. Det är revolutionernade och väldigt, väldigt glädjande, säger hon.
Hade förvarnat sina klienter
Jenny Fugleberg är kvinnornas ombud och säger att Hovrätten har gjort fel.
– Jag blev mycket överraskad. Mina klienter säger att de har tappat förtroende för rättsväsendet, säger hon.
Hon hade förvarnat sina klienter på att det fanns en möjlighet att åtalet skulle ogillas, men hon trodde det skulle sluta med att fängelsestraffet halverades. Hon kan i nuläget inte uttala sig om de kommer överklaga eller inte.
