"Warned by phone": former prisoner admitted that he infected his partner with HIV
In the Zayeltsovskiy District Court, the trial of a former prisoner infecting his partner with HIV is coming to a head. The man pleaded guilty, but claims that he warned his woman about his disease.
For more than three months, the Zaeltsovsky District Court has been considering the criminal case of Mikhail K. His former partner Svetlana said that the young man, upon returning from the colony, did not warn her about his HIV infection. The woman learned about the terrible diagnosis only two years later, after she had suffered for two years, without even knowing about the disease.
The man saw all this, watched me, and not a single muscle on his face trembled, – Svetlana recalls that terrible time. – He said: “Oh, what’s happening to you? I do not understand!” And I literally doubled over, I broke out all over. Such were the terrible pains.
After “Precedent” told the story of Svetlana, two years later, a criminal case under Article 122 of the Criminal Code of the Russian Federation “Infection with HIV” was nevertheless initiated. In June, the victim of the inmate had to meet with his former lover in court again .
For a long time he refused that he had infected Svetlana, hiding the truth, so the court needed to listen to both witnesses and examine the medical documents of the defendant. – When they interrogated Mr. K., he admitted that he had infected me, but stands on the position that he warned me by phone call from prison. And then there were witnesses: his mother and brother, who claim that he warned me in their presence, – says Svetlana. – Two months dragged out the trial, and suddenly they began to act as witnesses. But I will claim that they are perjury. Mikhail himself claims that I submitted an application to take revenge on him. He stands on the position that he passed the tests at the polyclinic number 22, at the place of residence, and he was not found to be HIV-positive. Now the court has again made inquiries to medical institutions to ascertain which of the parties is telling the truth and which is lying. Answers should come by October 13, and after that the parties can move on to the debate.

В Заельцовском районном суде подходит к кульминации судебный процесс о заражении ВИЧ-инфекцией своей сожительницы бывшим заключённым. Мужчина вину признал, но утверждает, что предупреждал свою женщину об имеющемся у него заболевании.
Вот уже больше трёх месяцев в Заельцовском районном суде рассматривают уголовное дело Михаила К. Его бывшая сожительница Светлана рассказала, что молодой человек, вернувшись из колонии, не предупредил её о своём заражении ВИЧ. О страшном диагнозе женщина узнала лишь спустя два года, после того, как два года терпела мучения, даже не догадываясь о заболевании.
Человек всё это видел, наблюдал за мной, и ни одна мускула на его лице не дрогнула, – вспоминает то страшное время Светлана. – Он говорил: «Ой, что с тобой происходит? Я не понимаю!» А я буквально загибалась, меня выламывало всю. Такие вот ужасные боли были.
После того, как «Прецедент» рассказал историю Светланы, спустя два года, уголовное дело по статье 122 УК РФ «Заражение ВИЧ-инфекцией» всё-таки было возбуждено. В июне жертве заключённого вновь пришлось встретиться с бывшим возлюбленным в суде. Он долго отказывался от того, что заразил Светлану, утаив правду, поэтому суду потребовалось выслушать и свидетелей, и изучить медицинские документы фигуранта.
— Когда допрашивали господина К., он признал, что меня заразил, но стоит на позиции, что он меня по телефонному звонку из тюрьмы предупреждал. А тут ещё появились свидетели: его мать и брат, которые утверждают, что он меня в их присутствии предупреждал, — рассказывает Светлана. — Два месяца тянули судебный процесс, и неожиданно они стали выступать в роли свидетелей. Но я буду заявлять, что они лжесвидетельствуют. Сам Михаил утверждает, что я подала заявление, чтобы ему отомстить. Он стоит на позиции, что сдал анализы в поликлинике №22, по месту жительства, и ВИЧ-инфекцию у него не обнаружили.
Сейчас суд сделал ещё раз запросы в медицинские учреждения, чтобы удостовериться в том, какая из сторон говорит правду, а какая лжёт. Ответы должны прийти к 13 октября, а после этого стороны могут перейти и к прениям.
