In Novosibirsk, man found guilty in allegedly infecting his wife with HIV and sentenced to one year in prison
The man convicted was diagnosed with HIV in 2012. The doctors told the patient about the rules of conduct with this disease, including the recommendation to avoid sexual intercourse. However, the man soon after diagnosis had sex with his ex-wife without precautions condom use. The woman was not warned of the diagnosis of her ex-husband.
In November 2014, the doctors made her the same diagnosis, said Vadim Grishin, prosecutor in this criminal case.
According to the testimony of the victim, they were married in 2003, the same year their child was born. In 2010, the couple got divorced, and during the following year came together again. Before the couple began to live together again, the woman was healthy.
The defendant explained that after learning from doctors about his diagnosis, he did not say anything to his wife. ‘Nothing was said about it, because he was shocked by this diagnosis was in prostration’. His diagnosis the inhabitant of Novosibirsk voiced to his wife after an unprotected intercourse.
The man admitted his guilt and was found guilty under the Article 122 of the Criminal Code (infection of another person with HIV by a person who knew about his/her health condition). The court sentenced him to one year in a penal colony. The court’s verdict has not come to force at the moment.

Однако мужчина вскоре после постановки диагноза занялся сексом со своей бывшей женой, не предохраняясь презервативом. Женщину о своем диагнозе бывший супруг не предупредил.
В ноябре 2014 года врачи поставили ей такой же диагноз – рассказал Вадим Гришин, гособвинитель по уголовному делу.
Согласно показаний пострадавшей, они состояли в браке с 2003 года, в том же году родился их ребенок. В 2010 году супруги развелись, а в следующем году опять сошлись. До того момента, как пара повторно начала жить вместе, женщина была здорова.
Подсудимый пояснил, что, узнав от врачей о своем диагнозе, он ничего не сказал жене. «Ничего не сказал об этом, так как был шокирован таким диагнозом, находился в прострации». Свой диагноз новосибирец озвучил супруге уже после незащищенного полового акта.
Мужчина полностью признал свою вину, и был признан судом виновным по ст. 122 УК РФ (заражение другого лица ВИЧ-инфекцией лицом, знавшим о своем заболевании). Суд назначил ему наказание – 1 год в колонии-поселения. Приговор суда в силу на данный момент не вступил.
