Kuzbass resident, who infected girls with HIV three times, sent to prison
The last identified victim of the HIV carrier was a 25-year-old woman from Kemerovo.
The Rudnichny District Court of the city of Kemerovo issued a verdict in a criminal case initiated against a previously convicted 31-year-old local resident. He was accused of committing a crime under Part 2 of Art. 122 of the Criminal Code of the Russian Federation “Infection with HIV”.
According to the press service of the Main Directorate of the Ministry of Internal Affairs of Russia for the Kemerovo Region, a 25-year-old resident of Kemerovo contacted the police, who said that her former partner had infected her with HIV. The investigator of the “Rudnichny” police department of the Ministry of Internal Affairs of Russia for the city of Kemerovo initiated a criminal case on this fact. During the preliminary investigation, it was established that the civilian spouse of the city dweller knew about the diagnosis given to him even before meeting her. However, the man did not inform his partner about the disease and, as a result, infected her with the human immunodeficiency virus. It should be noted that earlier he had already been twice prosecuted for similar crimes.
After collecting the evidence base, the criminal case was sent for consideration to the court, which found the defendant guilty and sentenced him to 3 years 2 months in prison with serving his sentence in a general regime correctional colony.
The Kuzbass police remind citizens that the criminal code of the Russian Federation provides for liability for HIV infection by a person who knew about this diagnosis. The sanctions of article 122 provide for imprisonment for up to five years. If the infected person has infected two or more persons or a minor, then a more severe punishment is applied – up to 8 years in prison. Рудничный районный суд города Кемерово вынес приговор по уголовному делу, возбужденному в отношении ранее судимого 31-летнего местного жителя. Он обвинялся в совершении преступления, предусмотренного ч. 2 ст. 122 УК РФ «Заражение ВИЧ-инфекцией».
Как рассказали в пресс-службе ГУ МВД России по Кемеровской области, в полицию обратилась 25-летняя жительница Кемерова, которая сообщила, что бывший сожитель заразил ее ВИЧ-инфекцией. Следователем отдела полиции «Рудничный» УМВД России по г. Кемерово по данному факту было возбуждено уголовное дело. В ходе предварительного следствия установлено, что гражданский супруг горожанки знал о поставленном ему диагнозе ещё до встречи с ней. Однако мужчина не сообщил партнёрше о заболевании и в результате заразил её вирусом иммунодефицита человека. Стоит отметить, что ранее он уже дважды привлекался к уголовной ответственности за аналогичные преступления.
После сбора доказательственной базы уголовное дело было направлено на рассмотрение в суд, который признал фигуранта виновным и приговорил его к 3 годам 2 месяцам лишения свободы с отбыванием наказания в исправительной колонии общего режима.
Полиция Кузбасса напоминает гражданам, что уголовный кодекс Российской Федерации предусматривает ответственность за заражение ВИЧ-инфекцией лицом, который знал о данном диагнозе. Санкции статьи 122 предусматривают лишение свободы на срок до пяти лет. Если же инфицированный заразил двух и более лиц или несовершеннолетнего, то применяется более жесткая мера наказания – до 8 лет лишения свободы. Более того, еще до встречи с кемеровчанкой и сожительства с ней мужчина точно знал, что болен. О заболевании он не стал сообщать партнерше. Кроме того, выяснилось, что ранее он дважды привлекался к уголовной ответственности за то же самое.
– В настоящее время уголовное дело направлено в суд. Санкции статьи обвинения предусматривают в качестве наказания до пяти лет лишения свободы, – сообщает пресс-служба ГУ МВД России по Кемеровской области.
За заражение ВИЧ-инфекцией лицом, которое знало о диагнозе, предусмотрено лишение свободы на срок до пяти лет. Если же человек заразил двух и более лиц, он может лишиться свободы на срок до восьми лет.
