4 years in jail for transmitting HIV
A South African man has been sentenced to four years in prison by the Mulhouse Criminal Court for transmitting HIV virus to his girlfriend, we learnt today from the woman’s lawyer
The young woman from Alsace had met this man in Germany, and was already the mother of one of his children when she realised that she had been infected.
Pregnant once again, in 2007, she was contacted by another woman who revealed that she had been infected during a relationship with her companion, when she was expecting a child. A screening then revealed that she too has AIDS.
Shortly after the birth of her child, and while the father of her child had disappeared for several months, the young Alsatian lodged a complaint. Her former companion was sentenced in absentia to four years in prison in 2014.
Finally arrested in December 2015 in Estonia, where he lived with his wife, the man was transferred to France in September 2016. He appeared yesterday in the Court in Mulhouse and was sentenced to four years in prison.
“He did not explain anything”, at the hearing yesterday, “nor has ever sought to contact her,” said Camille Gaudineau, the lawyer.
In December 2016, a man was convicted in his absence by the Criminal Court of the Gard for having transmitted the AIDS virus to his companion and sentenced to 12 years imprisonment.

Un Sud-Africain a été condamné à quatre années de prison ferme par le tribunal correctionnel de Mulhouse pour avoir transmis à sa compagne le virus du VIH, a-t-on appris aujourd’hui auprès de l’avocate de cette dernière.
Le jeune femme originaire d’Alsace avait rencontré cet homme en Allemagne, et était déjà mère d’un de ses enfants lorsqu’elle s’est rendue compte qu’elle avait été contaminée. A nouveau enceinte, en 2007, elle a été contactée par une autre femme qui lui a révélé avoir été contaminée au cours d’une relation avec son compagnon, dont elle attend un enfant. Un dépistage lui a alors appris qu’elle a elle aussi le sida.
Peu après son accouchement, et alors que le père de l’enfant s’était volatilisé depuis plusieurs mois, la jeune Alsacienne a porté plainte. Son ex-compagnon a été condamné par contumace à 4 ans de prison en 2014. Finalement arrêté en décembre 2015 en Estonie, où il vivait avec son épouse, l’homme a été transféré en France en septembre 2016. Il a comparu hier à Mulhouse, et a été condamné à quatre ans de prison. “Il n’a rien expliqué”, lors de l’audience qui a eu lieu hier, “ni n’a jamais cherché à prendre contact avec elle”, a indiqué Me Camille Gaudineau.
En décembre 2016, un homme avait été condamné en son absence par la cour d’assises du Gard pour avoir transmis le virus du sida à sa compagne à 12 ans de réclusion criminelle.
