Vendée : Man convicted of infecting three women with HIV
On Tuesday 14 January, the criminal court in La Roche-sur-Yon handed down its verdict in a painful case. A 28-year-old man from Côte d’Ivoire was found guilty of deliberately infecting three women with HIV between 2016 and 2017. He was sentenced to five years’ imprisonment, four of which were unsuspended, but escaped a committal order, raising a number of questions.
According to 20 Minutes, the accused, who had been infected with the virus since birth through his mother, had discovered his HIV-positive status at the age of 15. Although he began antiretroviral treatment at that time, he stopped taking it when he arrived in France, where treatment is covered. Despite being aware of his condition, he had unprotected sex with several women, infecting three of them.
Damning testimony in court
During the hearing, a victim aged 18 at the time of the events reported that the man had insisted on having unprotected sex, despite knowing that he was a carrier of sexually transmitted diseases. One of the civil parties’ lawyers expressed her fears about the possibility of other victims. ‘I was unconscious at the time. This is unfair. I only thought of myself’, said the defendant, trying to explain his behaviour.
Treatment abandoned in mainland France
According to his lawyer, the man stopped his antiretroviral treatment when he arrived in France, where he was living without papers. The drugs, which are fully reimbursed in France, could have considerably reduced the risk of transmitting the virus.

Un homme de 28 ans, originaire de Côte d’Ivoire, a été reconnu coupable d’avoir transmis volontairement le VIH à trois femmes entre 2016 et 2017. Condamné à cinq ans de prison, dont quatre ferme, il a toutefois échappé à un mandat de dépôt, suscitant des interrogations.
Une transmission délibérée malgré la connaissance de sa maladie
Selon 20 Minutes, portant le virus depuis sa naissance, transmis par sa mère, le prévenu avait découvert sa séropositivité à l’âge de 15 ans. Bien qu’il ait commencé un traitement antirétroviral à cette époque, il a cessé de le suivre à son arrivée en France, où les soins sont pourtant pris en charge. Malgré la connaissance de sa condition, il a entretenu des relations sexuelles non protégées avec plusieurs femmes, contaminant trois d’entre elles.
Des témoignages accablants au tribunal
Lors de l’audience, une victime âgée de 18 ans au moment des faits a rapporté que l’homme avait insisté pour avoir des rapports non protégés, tout en sachant qu’il était porteur de maladies sexuellement transmissibles. L’une des avocates des parties civiles a exprimé ses craintes quant à l’éventualité d’autres victimes. « J’étais inconscient à l’époque. C’est injuste. Je n’ai pensé qu’à moi », a déclaré le prévenu, tentant d’expliquer son comportement.
Un traitement abandonné en métropole
Selon son avocat, l’homme a cessé son traitement antirétroviral à son arrivée en France, où il vivait sans papiers. Les médicaments, entièrement remboursés dans l’Hexagone, auraient pu réduire considérablement le risque de transmission du virus.
