Seven months conditional: This is the verdict (not final) against a 20-year-old who slept with his girlfriend despite being infected with HIV – without a condom. The 20-year-old was charged by the public prosecutor for “deliberately endangering people with communicable diseases”. The fact that the patient did not feel the full harshness of this rare paragraph (three years imprisonment) is due to a fortunate circumstance: his partner was not infected.
Theft
In court, the 19-year-old described the agony she went through up to the negative diagnosis. Even the woman’s father was allowed to report on the “sheer horror”. The judge decided, of course, that she also had personal responsibility – she could have insisted on a condom. Incidentally, the punishment also relates to other offenses committed by the defendant: Among other things, he had stolen his ex’s laptop.

Der 20-Jährige wurde vom Staatsanwalt wegen „vorsätzlicher Gefährdung von Menschen durch übertragbare Krankheiten“ angeklagt. Dass der Kranke nicht die volle Härte dieses seltenen Paragrafen zu spüren bekam (drei Jahre Haft), verdankt er einem glücklichen Umstand: Seine Partnerin steckte sich nämlich nicht an.
Diebstahl
Vor Gericht schilderte die 19-Jährige die Qualen, die sie bis zur negativen Diagnose durchlebte. Sogar der Vater der Frau durfte über den „blanken Horror“ berichten. Der Richter entschied freilich, dass sie ja auch eine Eigenverantwortung trage – sie hätte auf ein Kondom bestehen können. Die Strafe bezieht sich übrigens auch auf andere Delikte durch den Angeklagten: Unter anderem hatte er den Laptop seiner Ex geklaut.
