HIV Patient Jailed For Unprotected Sex And Non-disclosure
A local court in Pennsylvania recently handed down a 33 to 66 month-prison term for an HIV-positive man who had unprotected sexual intercourse with three women without informing them of his HIV status.
Apparently, this wasn’t the first time the 26-year old X of Wilson Pennsylvania went to jail for the same offense. The recent case was actually his second.
He admitted guilt to all nine counts of reckless endangerment. On top of his prison sentence, X will also get two years of probation.
After his sentence was read, X expressed remorse but county Senior Judge Leonard Zito was not convinced.
“This ranks among the most cowardly of human acts. What he did, what X did, was to steal the lives of these young girls,” told Judge Zito as quoted saying by The Morning Call.
According to New York Times, X was living with HIV since birth. He was previously sentenced to a four-year prison term for failure to disclose his condition to two sexual partners including a minor back in 2010. He served two years in jail before being paroled.
So far, none of the three women whom X had unprotected sex with reported having HIV but they remained under constant medical monitoring until their testing period expires.
Assistant District Attorney Anthony Casola felt that X should get a tougher sentence for ruining the lives of his victims.
“I know that they’re going to be concerned about this for the rest of their lives,” remarked Casola as quoted in an article published by Lehig Valley Live.
Man faces trial for allegedly not disclosing HIV before sex
A Wilson Borough man who allegedly did not disclose to sexual partners he was HIV-positive is headed for trial in a case involving a Nazareth woman. RX, 25, of the 200 block of South 16th Street and previous addresses in Hunterdon County, appeared Wednesday before District Judge John Capobianco.
X faces three counts of reckless endangerment after allegedly having unprotected sex with a woman on Feb. 11, Feb. 24 and March 27 at a home in the 100 block of South Main Street in Nazareth.
In April, the victim read online news articles about X. HIV causes AIDS, a disease that weakens the immune system, gradually destroying the body’s ability to fight infections and certain cancers.
X in 2010 — when living in Hunterdon County — was jailed after having sex with a juvenile girl in Raritan Township. In 2006, X was interviewed as part of a series in marking the 25th anniversary of the discovery of AIDS, nj.com reports.
He talked about having contracted the disease from his birth mother and said he always had the support of his peers. He was adopted as an infant, according to the report.
Nazareth police later gathered medical and legal documentation proving he had contracted the HIV virus prior to having sex with the victim and knew he had the virus during the time of the act, court records say.
In a separate case, two Easton victims in August also came forward to policesaying they had sex with X and didn’t learn that he had contracted HIV until they read about his criminal history on the Internet.
In the Easton case, X faces a total of six counts of recklessly endangering others — three counts for each of his two victims. The charges stem from crimes that occurred at two different times with two different victims in Easton, police had said.
X previously waived his right to a preliminary hearing in both Easton cases, said Northampton County Assistant District Attorney Anthony Casola, who is prosecuting the case.
Casola said prosecutors will try to consolidate both the Nazareth and two Easton cases into a single case. A tentative formal arraignment date has been set for Dec. 10 in county court on all three cases.
Casola declined further comment. X did not have attorney representing him Wednesday.
In the Easton case, X was committed to Northampton County Prison in lieu of $100,000 bail — $50,000 for each of the two warrants issued. In Nazareth, Capobianco had set bail during his arraignment at $7,500, which X also failed to post.
