On March 12, 2025, the Kashkadarya Regional Criminal Court held an appeal hearing regarding the case of a defendant convicted under Article 113, Part 4 of the Criminal Code of Uzbekistan (knowingly transmitting HIV/AIDS). The appeal was heard in a closed court session and the state prosecutor, the defendant’s defense attorney, and the complainants were all present.
Background of the Case
According to the initial verdict issued by the Nishan District Criminal Court on January 9, 2025, the defendant was found guilty of intentionally infecting two individuals with HIV/AIDS despite being aware of his medical condition and the legal consequences of spreading the virus. The defendant was convicted for engaging in unprotected intercourse with his spouse, who later tested positive and donating blood to a patient, who was later diagnosed with HIV.
The defendant appealed the verdict, arguing that the sentence was too severe, considering the defendant’s confession and remorse and the fact that he was sole provider for his family.
After reviewing the evidence, including medical records, witness statements, and legal documents, the court dismissed the appeal and confirmed the 6-year imprisonment sentence.
