Uzbekistan: Court of appeal upholds five-year prison sentence for man accused of alleged HIV transmission

Background and Initial Conviction

On January 6, 2024, the Yashnabad District Criminal Court convicted X of knowingly transmitting HIV under Article 113, Part 4 of the Criminal Code of Uzbekistan. The court sentenced him to five years in prison.

The defendant filed an appeal, requesting a lighter sentence based on the following arguments: He was unaware that he was transmitting HIV, he partially confessed and expressed remorse and cooperated with the investigation. He also stated that the victim has not lodged a claim against him and he had no prior conviction.

Cassation Court Review and Ruling

On March 11, 2025, the Tashkent City Court’s Cassation Judicial Panel reviewed the case and rejected the appeal, citing the following reasons: Medical documents showed that the defendant was officially registered as an HIV patient and explicitly informed of the criminal liability for transmitting HIV.  While the court acknowledged the mitigating factors, it also considered the deliberate nature of his actions as an aggravating factor.

Final Verdict

The original five-year prison sentence remained unchanged. The cassation appeal was denied due to lack of legal grounds.

The defendant retains the right to file a final appeal with the Supreme Court of Uzbekistan.
