Court Overview:
On December 27, 2024, the Zangiota District Court of Tashkent Region conducted a closed court session to deliberate on a criminal case concerning the defendant accused under Part 4 of Article 113 of the Criminal Code of Uzbekistan. The case addressed the charge of knowingly placing another person at risk of HIV infection.
Case Background:
The defendant, born in 2004, has been living with HIV/AIDS since a young age. She was informed of her condition in 2007 and was regularly monitored by healthcare authorities. The defendant had received warnings regarding the risks of transmitting the virus and the legal consequences of failing to disclose her condition to sexual partners.
On the night of January 27–28, 2024, the defendant engaged in sexual intercourse with a man in a hotel located in Zangiota District without informing him of her HIV-positive status. The victim later testified that they met in a nightclub earlier that month and maintained regular communication before agreeing to meet. During their encounters, they engaged in protected and unprotected sexual activity, with the victim unaware of the defendant’s health condition.
Court Findings:
The court concluded that the defendant’s guilt was fully established through medical records, receipts, and other evidence demonstrating her awareness of her condition and prior warnings. The court acknowledged the defendant’s mitigating circumstances, such as her young age, disability, lack of prior convictions, and expressed remorse.
The court found the defendant guilty under Part 4 of Article 113 of the Criminal Code of Uzbekistan. The defendant was sentenced to 3 years restriction of liberty where her movements and activities would be strictly regulated. The sentence reflects the gravity of the offense and adherence to public health and legal principles.
