A resident of Yalutorovsk will pay two million roubles for HIV infection
A resident of Yalutorovsk will pay two million roubles as compensation for moral damage to his former lover for infecting her with HIV infection.
‘Yalutorovsk district court considered a criminal case against D., accused of infecting another person with HIV infection by a person who knew that he had this disease (part 2 of article 122 of the Criminal Code of the Russian Federation),’ – reports the united press service of the judicial system of the Tyumen region.
It was established that the defendant from 1 February 2017 was put on notice that he was infected with human immunodeficiency virus. He was obliged to observe precautions to exclude the spread of HIV infection, but he did not do this and infected his girlfriend.
The victim testified that D. responded negatively to her questions about whether he had any sexually transmitted diseases. She could have contracted the disease only from him, as she had no other partners at that time.
The court, in addition to compensation for moral harm, taking into account all the circumstances of the case, imposed a sentence of deprivation of liberty for 2 years and 6 months, to be served in a penal colony.

Два миллиона рублей в качестве компенсации морального вреда заплатит житель Ялуторовска бывшей возлюбленной за то, что заразил ее ВИЧ-инфекцией.
“Ялуторовский районный суд рассмотрел уголовное дело в отношении Д., обвиняемого в заражении другого лица ВИЧ-инфекцией лицом, знавшим о наличии у него этой болезни (ч. 2 ст. 122 УК РФ)”, – сообщает объединенная пресс-служба судебной системы Тюменской области.
Установлено, что подсудимый с 1 февраля 2017 года поставлен в известность, что заражен вирусом иммунодефицита человека. Он был обязан соблюдать меры предосторожности, чтобы исключить распространение ВИЧ-инфекции, но не сделал этого и заразил подругу.
Потерпевшая показала, что на ее вопросы о наличии у него заболеваний, передающихся половым путем, Д. отвечал отрицательно. Заразиться могла только от него, поскольку в тот период других партнеров у нее не было.
Суд, кроме компенсации морального вреда, учитывая все обстоятельства дела, назначил наказание в виде лишения свободы на 2 года 6 месяцев с отбыванием в колонии-поселении.
