According to the Tennessee Court of Criminal Appeals. Yes. Last week the Court of Criminal Appeals, in State of Tennessee v. X, concluded that because the State failed to establish an element of the offense, the evidence was insufficient to support the defendant’s conviction of criminal exposure to HIV, and his conviction must be reversed and the charge dismissed.
