Convicted for the crime of transmitting the HIV VIRUS!
I.N was arrested at home in April this year, when, being heard in a case, he caused a wound with a pencil, after which he tried to cause an injury to the policeman, with the same pencil, saying -i “I will give you my blood and you, to have AIDS and you, to see how it is”. He was sent to court for outrage, but also for attempting the crime of transmitting the acquired immunodeficiency syndrome, provided by art.32 C.penal rap. the art. 354 para.1 C.penal.
The defendant received 6 months for outrage and 1 year for attempted crime of transmitting the acquired immunodeficiency syndrome. “It merges the sentence of 6 months imprisonment with the sentence of 1 year imprisonment, in the end it will execute the heaviest sentence of 1 year imprisonment, to which is added 1/3 of the other sentence -2 months imprisonment. It results for the defendant IN, the punishment of 1 year and 2 months imprisonment ”, according to the court minute.
Everything happened on April 18, 2018, when I.N. appeared, in order to be heard as an injured person in the criminal case no. 1751 / P / 2017 of the Prosecutor’s Office attached to the Medgidia Court, at the Siliștea Police Station. At one point, the chief MS agent noticed that the individual, sitting in the chair in front of the office, had in his pocket the vest with which he was wearing a mobile phone with a forward-facing video camera, with which he seemed to be filming.
The police officer pointed out that he did not have the right to film, after which he asked him to put the phone on the desk, and he would recover it at the end of the interrogation activity. The suspect refused to comply. Next, the policeman took off the leather jacket he was wearing and went to the hanger behind the access door to the office. To hang his jacket on the hanger, he pushed open the door without closing it completely.
In the next few moments, I., probably scared by the gesture of closing the door, took from a support on the desk a metal pencil with a metal tip with which he quickly applied 2-3 blows to his right forearm, causing in this way an open wound that bled, then rushed to the law enforcement officer, according to rolii.ro, who was, somewhat, with his back to the suspect and hit him 2-3 times in the back, in the right shoulder area, after which he rubbed the tip of the mechanical pencil against the shirt of the uniform the police officer was wearing, trying to inflict an open wound on him.
“I will give you my blood and you, to have AIDS and you, to see how it is,” he said during this time. To defend himself, the lawman pushed him. He finally admitted his deed, stating that he reacted in this way because he thought his phone would be taken. As for the fact that he wanted to film, he explained that he did not trust the policeman and believed him to be biased. Specifically, he had the impression that he was on the side of those who vandalized his car.
Condamnat pentru infracțiunea de transmitere a VIRUSLUI HIV!
I.N. a fost arestat la domiciliu în aprilie anul curent, când, audiat fiind într-un dosar, și-a provocat o rană cu un creion, după care a încercat să-i provoace polițistului o leziune, cu același creion, spunându-i ”O să-ți dau sângele meu și ție, să ai SIDA și tu, să vezi cum e”. A fost trimis în judecată pentru ultraj, dar și pentru tentativă la infracțiunea de transmitere a sindromului imunodeficitar dobândit, prevăzută de art.32 C.penal rap. la art. 354 alin.1 C.penal.
Inculpatul a primit 6 luni pentru ultraj și 1 an pentru tentativă la infracțiunea de transmitere a sindromului imunodeficitar dobândit. ”Contopește pedeapsa de 6 luni închisoare cu pedeapsa de 1 an închisoare, în final va executa pedeapsa cea mai grea de 1 an închisoare, la care se adaugă 1/3 din cealaltă pedeapsă -2 luni închisoare. Rezultă pentru inculpatul I.N, pedeapsa de 1 an și 2 luni închisoare”, potrivit minutei judecătorești.
Totul s-a petrecut pe 18 aprilie 2018, când I.N. s-a prezentat, în vederea audierii sale în calitate de persoană vătămată în dosarul penal nr. 1751/P/2017 al Parchetului de pe lângă Judecătoria Medgidia, la Postul de Poliție Siliștea. La un moment dat, agentul principal M.S. a observat că individul, așezat pe scaunul din fața biroului, avea în buzunarul vestei cu care era îmbrăcat un telefon mobil cu camera video orientată către înainte, cu care părea că filmează.
Lucrătorul de poliție i-a atras atenția că nu are dreptul să filmeze, după care i-a solicitat să pună telefonul pe birou, urmând să și-l recupereze la finalizarea activității de audiere. Suspectul a refuzat să se conformeze. În continuare, polițistul s-a dezbrăcat de geaca de piele cu care era îmbrăcat și s-a îndreptat către cuierul amplasat în spatele ușii de acces în birou. Pentru a-și agăța geaca în cuier, acesta a împins ușa fără a o închide total.
În momentele imediat următoare, Ionel, speriat, probabil, de gestul închiderii ușii, a luat dintr-un suport aflat pe birou un creion metalic cu vârful din metal cu care și-a aplicat rapid 2-3 lovituri în antebrațul drept, provocându-și în acest fel o rană deschisă care a sângerat, apoi s-a repezit către omul legii, potrivit rolii.ro, care se afla, oarecum, cu spatele la suspect și l-a lovit de 2-3 ori în spate, în zona umărului drept, după care a frecat vârful creionului mecanic de cămașa uniformei cu care era îmbrăcat lucrătorul de poliție, încercând astfel să-i provoace acestuia o rană deschisă.
”O să-ți dau sângele meu și ție, să ai SIDA și tu, să vezi cum e”, spunea în acest timp. Pentru a se apăra, omul legii l-a împins. În cele din urmă și-a recunoscut fapta, precizând că a reacționat în acest mod întrucât a crezut că-i va fi luat telefonul. Cât despre faptul că a vrut să filmeze, a explicat că nu avea încredere în polițist și îl credea părtinitor. Mai exact, avea impresia că ține partea celor care i-au vandalizat mașina.
