In Moscow, a man who infected his partner with HIV was convicted.
MOSCOW, May 12 – RIA Novosti. On Tuesday, the Kuzminsky court in Moscow passed a sentence under one of the rarest articles of the Criminal Code “HIV infection” – a man was sentenced to two years conditionally for infecting his partner, the court’s press service told RIA Novosti.
The court found X. guilty of committing a crime under Part 2 of Article 122 of the Criminal Code of the Russian Federation (infection of another person with HIV infection by a person who knew about the presence of this disease), and sentenced him to two years’ suspended imprisonment, with the imposition of additional duties, “- said the source of the agency.
The court was not able to provide the details of this case – the trial was held in a closed regime in connection with the personal medical data in the materials.
Criminal cases under the article “Infection with HIV infection” are very rare in court practice, in Moscow over the past five years, no more than five such sentences were passed.
RIA Novosti had at its disposal a sentence from another case, where the defendant was accused of a similar crime and even received the same punishment. In that decision the court was guided by the fact that the defendant knew about his status and was obliged to observe the relevant sanitary and hygienic rules, but regularly had sexual relations with his cohabitant without using contraception. The victim, who did not know that her partner had an illness, was eventually infected.
